That might seem like a silly question, except in Virginia a new law blurs the distinction.
If you go more than 35 mph on a moped or scooter, it's now considered a motorcycle.
That means you'll have to have a motorcycle license, insurance and additional certification.
Also, you'll need license plates and proper registration.
Under 35 mph you don't need a license but you do have to carry identification.
The new law went into effect July 1.
