Hagerstown man denied new trial in infant's death

HAGERSTOWN, Md. - A Hagerstown man serving 30 years for shaking his girlfriend's infant son to death won't get a new trial.
The Herald-Mail (bit.ly/Qnc1tV) reported Tuesday that a judge has denied 26-year- old Floyd Bingaman's motion to re-open his case.
A jury convicted Bingaman in 2007 of involuntary manslaughter and first-degree child abuse in the death of 4-month-old Justice Myers-Cannon.
Bingaman had claimed ineffective assistance by his trial defense attorney.
The case led to the passage of a state law this year that increased the maximum penalty for first-degree child abuse resulting in death to 40 years from 30.
