New trial for man convicted in WVa player's death

CHARLESTON, W.Va. (AP) -- The West Virginia Supreme Court has ordered a new trial for a Charleston man convicted in the fatal shooting of former Marshall University football player Donte Newsome.

The court on Thursday overturned the conviction of Jerel Addison Garner on charges of voluntary manslaughter, wanton endangerment and a concealed weapons violation. Garner was sentenced to up to 25 years in prison.

Newsome was shot outside a Huntington nightclub in 2008.

The high court said its ruling is based on the issue of Garner's right to effectively cross-examine a key witness. The court said Garner's Sixth Amendment right of confrontation was denied in ordering a new trial.

Newsome was originally from Chesapeake, Va. He lettered at linebacker at Marshall from 2002 to 2005.
