Va. HS students charged with child porn defend themselves

high school students arrested for possession and distribution of child pornography are disputing the allegations and say the teens were involved in consensual sex.

Rod Leffler, defense attorney for the youngest West Springfield High School boy charged, says one of the boys merely used his smartphone camera to videotape friends having consensual sex at a party.

“They were all foolish,” Leffler tells WUSA 9.

Leffler says the videos don’t show that the girls were incapacitated or passed out.

“The girls are speaking directly to the cellphone camera,” says Leffler.

He says one girl, seen nude from the waist up, sings a song.

“The other one is facing the camera, talking to the camera, while she’s engaged in fondling with a boy,” Leffler tells WUSA.

The attorneys for the three boys, whose ages range from 14 to 16, say the videos were shared among friends but never uploaded to the Internet.

“I can see why the girls would want to say they didn’t know they were being filmed,” Leffler says, “but the evidence so far is that they do.”

Fairfax County Commonwealth’s Attorney Ray Morrogh has said the girls involved would not be charged.
