RICHMOND, Va. - A man who pleaded no contest to the 2010 killing of a Petersburg man outside a Richmond club is scheduled for sentencing Nov. 26.

The Richmond Times-Dispatch ( reports that Kevin Cunningham entered the plea Wednesday in the fatal shooting of 20-year-old Jeremy Uzzle. Under the plea agreement, Cunningham faces a punishment of no more than 21 years and eight months in prison, the high end of state sentencing guidelines.

Cunningham was found guilty in October 2010 in the death of Uzzle during a confrontation in April of that year. He was sentenced to 25 years in prison.

In January, however, the Virginia Court of Appeals found that prosecutors should not have been allowed to impeach Cunningham's character with evidence that he illegally bought the gun used in the crime.
