Dollar Tree plaintiffs seek class certification

NORFOLK, Va. -- Nearly 6,300 Dollar Tree employees are waiting to hear whether a federal judge in Norfolk certifies a lawsuit over wages as a class action.

The workers claim they often worked through their unpaid half-hour lunch breaks and are now seeking overtime for those hours. The lawsuit alleges that to provide low-cost merchandise and still maximize profits, Dollar Tree maintained a policy or practice of requiring thousands of hourly employees and assistant managers to work without pay.

The Virginian-Pilot reports ( ) that U.S. District Judge Raymond Jackson has granted conditional certification of the class. Attorneys from both sides will present additional evidence before Jackson makes a final decision.

Tim Reid, a spokesman for Chesapeake-based Dollar Tree, said the company has a longstanding policy not to comment on pending litigation.
