Md. court dismisses swim school’s lawsuit

WESTMINSTER, Md. (AP) — A Carroll County judge is dismissing a lawsuit filed by a children’s swimming school chain against the state Department of Health and Mental Hygiene.

The order was entered Tuesday by Judge Thomas Stansfield.

Fallston-based Kids First Swim Schools had alleged negligence, libel, slander and interference with contractual relations. The lawsuit stemmed from the department’s 2012 suspension of a permit for a pool in Finksburg because chlorine levels were too high.

The school claimed the Finksburg location was unfairly singled out for enforcement.

Stansfield ruled that it cannot be defamatory for government officials to communicate truthfully that an individual or organization is in violation of a regulation.
