CHARLOTTESVILLE, Va. -- An Albemarle County official who pleaded guilty to sexual battery is challenging a petition seeking his removal from office.
Media outlets report that Supervisor Christopher J. Dumler's attorney asked a judge this week to dismiss the petition. A motion filed by attorney Jessica Phillips says the petition's language doesn't match a bill of particulars filed by special prosecutor Michael Doucette.
Resident Earl Smith submitted the petition. He contends that Dumler's conviction on the misdemeanor charge is hampering his ability to serve.
A bench trial on the petition is set for May 20 in Albemarle County Circuit Court.
Dumler pleaded guilty in January. He has said he won't resign but he won't seek re-election.
